Terms of Service

Welcome to Spleis. By downloading, installing, or using the Spleis app ("the app", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the app.

1. Description of Service

Spleis is a mobile application that allows parents and guardians to generate personalized bedtime stories for children. Stories are generated using artificial intelligence (OpenAI's API) based on user-selected subjects, themes, settings, and preferences.

2. Eligibility

The app is designed to be used by parents and guardians. By using Spleis, you confirm that you are at least 18 years of age or the age of legal majority in your jurisdiction. Children should only use the app under parental supervision.

3. Free Trial & Subscriptions

Spleis offers a 7-day free trial with full access to all features. After the trial period, continued use requires an active subscription:

• Monthly: €4.99 per month
• Yearly: €49.99 per year

Subscriptions are billed through your Apple ID account and managed entirely by Apple. Key details:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
• You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

We reserve the right to change subscription pricing. Any price changes will apply to the next billing cycle after notice is provided.

4. AI-Generated Content

Stories created by Spleis are generated by artificial intelligence. While we enforce strict safety guidelines (positive tone, no violence, no horror, age-appropriate language, and happy endings), please note:

• AI-generated content may occasionally contain minor imperfections, inconsistencies, or unexpected phrasing.
• We do not guarantee that every generated story will perfectly meet your expectations.
• We recommend that parents review stories before reading them to children.

We continuously work to improve story quality and safety, but the nature of AI generation means no output can be guaranteed to be flawless.

5. Content Ownership

Stories generated through Spleis are created for your personal, non-commercial use. You may:

• Read, save, and share generated stories with family and friends.
• Print stories for personal use.

You may not:

• Sell, license, or commercially distribute generated stories.
• Claim authorship of AI-generated stories for commercial publication.
• Use the app to generate content for other AI training datasets.

The Spleis name, logo, and app design remain our intellectual property.

6. Acceptable Use

You agree to use Spleis only for its intended purpose: creating bedtime stories for children. You may not:

• Attempt to bypass, modify, or reverse-engineer the app or its safety filters.
• Use the app to generate content that is harmful, offensive, or inappropriate.
• Interfere with the app's functionality or overload our services.
• Use automated tools, bots, or scripts to interact with the app.

We reserve the right to restrict or terminate access for users who violate these terms.

7. Availability & Interruptions

We strive to keep Spleis available and functioning at all times, but we cannot guarantee uninterrupted service. The app may be temporarily unavailable due to:

• Maintenance or updates
• Server or API outages (including OpenAI service disruptions)
• Network connectivity issues on your device

We are not liable for any loss or inconvenience caused by temporary service interruptions. Saved stories remain available offline regardless of service status.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Spleis is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the app will be error-free, uninterrupted, or that AI-generated content will be perfectly accurate or suitable for every situation.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.
• Our total liability for any claim related to the app shall not exceed the amount you have paid for your subscription in the 12 months preceding the claim.

9. Privacy

Your use of Spleis is also governed by our Privacy Policy, which describes how we handle your data. By using the app, you agree to the practices described in the Privacy Policy.

10. Third-Party Services

Spleis relies on the following third-party services:

• OpenAI — for AI story generation, subject to OpenAI's Terms of Use
• Apple App Store — for distribution and subscriptions, subject to Apple's Standard EULA

We are not responsible for the availability, performance, or policies of third-party services.

11. Termination

You may stop using Spleis at any time by uninstalling the app and cancelling your subscription through Apple. We may suspend or terminate your access if you violate these Terms, without prior notice and without liability.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated effective date. Continued use of the app after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the country where the developer resides, without regard to conflict of law provisions.
